Terms of Use & Privacy Policy Welcome to Modern Tailor (ModernTailor). Modern Tailor provides its service for you subjected to the following conditions. If you visit or shop at Modern Tailor, you agree and accept these conditions. Please read them carefully. In addition, when you use any current or future Modern Tailor's service or visit or purchase from any business affiliated with Modern Tailor, whether or not included in the Modern Tailor website, you will also be subjected to the guidelines and conditions applicable to such service or business. Collection, processing and usage of your data You can visit our web site without registering any personal data. We are only recording access data without personal relation like the name of your Internet service provider, the web site you are visiting us from or the name of the requested file. This data is used exclusively to improve our services and we are not able to connect the data directly to you. Personal data is only being recorded if you voluntarily register it during the purchase process when creating a new customer account or when registering for a newsletter. Without any additional permission we will use your data exclusively to complete and process your order. After completion and payment of an order your data will be locked from further usage and deleted after valid expiration time as established in tax and trading laws unless you have agreed on further usage of your data. With the subscription of our newsletter your e-mail address will be used for this purpose until you unsubscribe from the newsletter via our unsubscribe link. If you choose not to provide certain requested personal information, you will not be able to register as a ModernTailor customer or use our online tailoring or website services. We do not and will not sell or in any way share your personal information and email address with third party companies or agencies. Forwarding of personal data Relevant personal data may be forwarded to the transport company if this is necessary to deliver the goods. For the completion of payments we are forwarding payment data to our payment provider. All data forwarding take place through a highly secure data connection. Your personal data will not be forwarded to anyone else than those mentioned above. Data security Your credit card data will be transmitted encrypted with Secure Sockets Layer (SSL) v3, SHA-1 with RSA-encryption of 256 Bit. We are protecting our web site and other systems with the help of technical arrangements against loss, damage, access, change or spreading of your data by unauthorized persons. The access to your customer account is only possible after entering your personal password. We ask you to handle your login data with care and close the browser window after you are finished with the communication with us, especially when using the computer together with others. Cookies We use our own and third party cookies for statistical purposes and in order to facilitate and securely manage the purchasing process when you are visiting the site. We use third party advertising companies to track cookies in order for us to reach our target audience. "Cookies" are an industry standard way to improve the usage and usability of the Internet. Unsubscribing From Email Subscriptions: From time to time ModernTailor may send you electronic email marketing material. You may unsubscribe at anytime: 1. Open any newsletter sent by ModernTailor Promotions, Offers and Giveaways Occassionally, we launch offers & giveaways via our Facebook page or Instagram page. These promotions are in no way sponsored, endorsed, administered by or associated with Facebook or Instagram. Moderntailor reserves the right to determine the winning entry. Winners will be informed via the respective social/web channel where the competition was posted. Prize collection within 90 days otherwise it expires. Business Transfer In the event of a sale or business transfer, ModernTailor may disclose your personal information to the acquiring organization, but will require the acquiring organization to agree to protect the privacy of your personal information in a manner that is consistent with this User Agreement & Privacy Policy. ModernTailor has no responsibility and/or liability for the acquiring organization's use and disclosure of your personal information. Privacy & Security Statement If you shop at Modern Tailor and place your orders through our website or choose to place orders by phone or email or online platform, all personal information (your name, address, phone number and e-mail address plus credit card information) that you may share with us is kept absolutely private. Neither your name nor anything about you is sold or shared with any other companies or agencies. We appreciate the constant concern for security and utilize one of the safest and respected online transaction methods to keep your financial information protected. Data Retention We retain personal information in accordance with record retention policies. Our record retention duration are established by consideration of requirements of privacy laws, the purposes for which the information was collected, legal and regulatory requirements to retain the information for minimum periods, limitation periods for taking legal action, and our business purposes. Trademarks Modern Tailor and other marks indicated on our site are registered trademarks of Dragon Group Asia, Ltd. Modern Tailor, and other logos, images, page headers, button icons, scripts, and service names are trademarks or trade dress of Modern Tailor. Modern Tailor's trademarks may not be used in connection with any product or service that is not Modern Tailor's, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits Modern Tailor. Copyright Complaints Modern Tailor respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us. Risk of Loss All items purchased from Modern Tailor are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Product Descriptions Modern Tailor attempts to be as accurate as possible. However, Modern Tailor does not warrant that product descriptions or other contents of this site are accurate, complete, reliable, current, or error-free. Pricing and Order Confirmation Except where noted, otherwise, the List Price displayed for products on our website represents the full retail price listed on the product itself. When confirmation of order is received, this is to indicate that we have received the order. However, it does not indicate that a contract exists between customer and Moderntailor. Moderntailor will indicate acceptance of your order, and hence a contract between us, when we send the customer a confirmation of shipment. We have included this term to protect us in the case a mistake has been made in pricing, inadvertent under-pricing of goods, or inability to supply a particular product for any good reason. In the case of a change in price, Moderntailor will contact the customer first to ensure that the new price is acceptable. Possible VAT and custom fees are NOT included in the prices. You, as a consumer/customer/recipient, are responsible for paying any additional VAT and custom charges upon delivery of the goods. The prices are subject to change due to circumstances that Modern Tailor cannot control, such as substantially increased fabric prices, currency exchange rates, shipping costs, import fees or VAT. Please note that this policy applies only to products sold and shipped by Modern Tailor. Payment You may select from the following options · - By VISA or Mastercard. No extra charges will apply. · - Via Paypal. Extra charges (Paypal fees) may apply. The processing of your order will start after the order value has been paid. When paying via credit card the order value will be withdrawn directly. Shipping and Delivery Agreement Moderntailor offers you the choice to select your preferred shipping option during checkout. Standard Delivery is normally shipped by airmail. We use EMS (Express Mail Service) International to ship items when this is selected. When it reaches the destination country, your country’s postal service takes over the delivery of the package to your address. Customer can also select Expedited Shipping. This type of shipping uses Fedex or DHL or other couriers that can best deliver the package to your doorstep at the committed timeframe. Modern Tailor reserves the right to select the type of courier to use depending on the fastest delivery time and shipping address location. Post Office Box (PO Box) addresses and Military addresses cannot be used for shipments. Street addresses must be provided. Depending on the shipping method you selected, our custom made products are normally delivered within about 15-25 days, however the delivery time cannot be guaranteed. In certain circumstances, such as when fabric has run out or measurements are incorrect, the dispatch time may increase by a couple of days. We always do our best to maintain the 15-25 days schedule and deliver our goods to your door as swiftly as possible. Moderntailor will not be liable for any delays in shipping due to any conditions beyond our control such as business or address being closed at time of delivery or the lack of signature or recipient, shipping stoppages, customs inspections delays, loss of shipment due to incorrect address and contact details. Packages sent back to Modern Tailor (ModernTailor) by your post office or Fedex/DHL, can be re-delivered to you the soonest we receive them but you agree to be charged with a shipping fee equal to the original invoice. The cost of shipping of an order is included in the total price of the order but should there be any import duties in the port of delivery, this is the responsibility of the receiver. There is an exemption quota in most countries that allows some merchandise, depending on the value of the package, to be received free from taxes and duties. The exemption quota varies from country to country. For countries like United States, Australia, New Zealand, France, and UK, packages are received free of taxes and duties when the value does not exceed US$200. For other countries, please check with your local customs office. We will however do try to minimize this as much as possible by declaring the package worth a replacement value or you can request at sales@moderntailor.com to declare low value in the shipping invoice. Generally this would not incur any customs duties. Items/garments, except ties and cufflinks, ordered from Moderntailor are custom-made to specific measurements. Thus, we discourage returns of garments. However, we understand that custom tailoring can be quite tricky. If you (customer) are not fully satisfied with the garments received, please email us at sales@moderntailor.com to determine the best step to take. Our customer service staff will be more than happy to handle your concerns. Our Product Complaints Policy shall be followed in this case. https://moderntailor.com/pub/index.do?action=faq&id=7#51 "Change of mind" - Except on purchased gift certificates, Moderntailor will not accept returns or refunds when customer simply changes their minds about the items/garments. This includes purchases made in error e.g. accidentally ordered the wrong size or incorrectly assigned a measurement profile, or incorrect colour selected, items that don't fit the way that you would like or unwanted gifts. If the items/garments are faulty please see our Product Complaints Policy https://moderntailor.com/pub/index.do?action=faq&id=7#51 . It is always best to communicate with us as we handle issues and resolutions on a case to case basis. In the event that a return is approved even when determined that Moderntailor has followed the requirements for the garments in accordance with our production process, restocking fees shall apply. Restocking fees will be deducted from the refund, unless your item qualifies for free returns. The following conditions shall also apply: · - The garments should be returned within 7 days from receiving confirmation from Moderntailor that the garments can be returned. · Product quality issues should be reported within 7 days upon delivery. · - Garments must be unworn, unwashed, unused with all original tags/labels attached. · - Garments must be returned safely in the same condition we sent it. · - Please include all documentations, product information and original packaging with the item intact. · - Customer shall shoulder fees in shipping the garments to our office in Shanghai, China. · - Customer is responsible for the item/package while in transit until it reaches us. · - Moderntailor will not be responsible for handling tariffs and taxes that will be incurred in the process. · - The refund shall be issued back in your original payment method, upon receipt of the garments. Customer may opt for store credit instead of a refund. The credit will be added to the customer's Moderntailor account which can be used towards a future purchase. Restocking Fee: Cancellations while items/garments are in production. · - Orders/garments that are not yet in production shall be refunded in full, including shipping fee. · - Moderntailor shall impose 50% restocking fee when garments to be cancelled are already in production. This will be deducted from the cost of fabric/item. Shipping fee shall be refunded in full.
In case of force majeure, the agreement is considered judicially cancelled with neither customer nor Modern Tailor being entitled to any compensation. Modern Tailor considers force majeure as war, terrorism, strikes, legislative changes, natural catastrophes, the lack of on-time delivery by suppliers to Modern Tailor, and any other circumstances that are beyond our control. INDEMNITIES By using our website, you agree to defend, indemnify and hold Moderntailor and its owners, workers, and clients, and representatives harmless from all claims, demands, causes of actions, damages, liabilities, costs and expenses, including attorneys' fees, arising from or related to in any way to your use of this Website and/or the sales or services of Moderntailor; your failure to comply with this agreement; and/or your violation of the rights of any third party. Site Policies & Modification Moderntailor reserves the rights to make changes to our site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
